1. Event: The Event means any and all activities associated with the organisation and participation of the Ocean Rockpool Tour – Charity Swim, including any pre and post The Event activities as specified by the Organizers.
2. Assumption of Risk: I knowingly take part in The Event at my own risk. I understand that attending or participating in The Event involves risks, including but not limited to, physical injury, property loss or damage and other risks to myself and others. I voluntarily assume all risks associated with my involvement, attendance and participation and take full responsibility my actions and inactions associated with The Event.
3. Medical Conditions: I certify that I am physically fit and have no medical conditions that would prevent my participation in swimming or other activities associated with this event. I understand it is my responsibility to consult with a physician/healthcare professional if I have any health concerns prior to The Event.
4. Participation: I am free to choose my own level of participation in The Event. If I am not confident to swim in rockpools or have had little experience swimming in rockpools, I will advise one of the Organizers prior to The Event. Children (under 16ys) and those with special needs must be supervised by their own carers at all times. I also agree to abide by the Safety Rules and Procedures.
5. No Liability for Injury or Damage: I acknowledge that the Non for Profit Organisation, The Ocean Rockpool Tour INC, organizers, volunteers, agents, and the Charities associated with the Event (collectively known as ‘The Team)’ shall not be held responsible for any injury, illness, loss, or damage to myself, my property, or my guests that may occur as a result of my attendance or participation in this event, whether caused by negligence or otherwise. The Northern Beaches Council requires The Ocean Rockpool Tour INC to have public liability that provides cover for injury to the public arising from activities and participation of The Team and participants in The Event.
6. Personal Responsibility and Safety: I agree to exercise caution and follow all safety instructions and advice given by the Organizers, Safety Officer, Pool Officer and relevant Authorities. I acknowledge that I cannot be supervised at all times and I understand that I am responsible for my own safety and the safety of any people in my care.
7. Release and Waiver: I hereby release and hold harmless the Ocean Rockpool Tour INC, Organizers and The Team from any and all claims, demands, causes of action, and damages, whether foreseeable or unforeseeable, arising out of or related to my attendance or participation in The Event.
8. Photo and Video Consent: I acknowledge that photographs and videos may be taken during The Event by The Team and the participants and agree that the Organizers may use these images for promotional purposes without compensation.
9. Cancellation: Should The Event be cancelled for any reason in part or full. No refunds will be provided, and no liability will be associated with the Ocean Rockpool Tour INC.
